Terms of Service

These Terms of Service ("Terms") govern your use of the NetMap Pro software application ("Software") provided by Executive Technology Group ("we," "us," or "our"). By downloading, installing, or using the Software, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for your personal or internal business purposes.

2. Restrictions

You agree not to:

• Copy, modify, distribute, sell, or sublicense the Software or any portion thereof
• Reverse engineer, decompile, or disassemble the Software, except to the extent permitted by applicable law
• Remove or alter any proprietary notices, labels, or marks on the Software
• Use the Software for any unlawful purpose or in violation of any applicable local, state, or federal laws
• Use the Software to scan networks without proper authorization from the network owner
• Redistribute, lease, or make the Software available to third parties as a hosted or managed service

3. Intellectual Property

The Software, including all code, design, graphics, documentation, and related materials, is owned by Executive Technology Group and is protected by copyright, trade secret, and other intellectual property laws. These Terms do not grant you any ownership rights in the Software. All rights not expressly granted herein are reserved.

4. Your Data

NetMap Pro operates entirely on your local device. All network scan data, device information, project files, and configurations remain stored locally on your machine. We do not collect, access, or transmit your project data. You are solely responsible for backing up your data.

5. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or free of harmful components. We do not warrant the accuracy or completeness of network scan results, device identification, or OUI lookups. You acknowledge that network scanning may produce incomplete or inaccurate results depending on network configuration, device behavior, and environmental factors.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXECUTIVE TECHNOLOGY GROUP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you for all claims arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Executive Technology Group from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Software, your violation of these Terms, or your violation of any rights of a third party, including unauthorized scanning of networks.

8. Termination

We may terminate or suspend your license to use the Software at any time, without prior notice, if you breach any provision of these Terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Sections 3, 5, 6, 7, 9, and 10 shall survive termination.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11. Entire Agreement

These Terms constitute the entire agreement between you and Executive Technology Group regarding the Software and supersede all prior agreements, representations, and understandings.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Software after any changes constitutes your acceptance of the revised Terms.
